Terms of Service

1. Acceptance of Terms

These Terms of Service govern your use of the Nourish iOS app and nourishhealth.app. By using Nourish, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Wellness and AI Disclaimer

Nourish is a wellness and nutrition-tracking tool, not a medical device or healthcare provider. It does not diagnose, treat, cure, or prevent disease. Meal recognition, nutrition values, gut scores, recipes, and AI-generated insights are estimates and may be incomplete or incorrect. Do not use Nourish for emergencies or as a substitute for advice from a qualified healthcare professional.

3. Accounts

You are responsible for keeping your account secure and for activity under it. You agree to provide accurate information, use only an account you are authorized to control, and notify us if you believe your account has been compromised.

You can delete your account from Settings in the app. Account deletion is permanent, but it does not cancel an Apple subscription. Limited records may be retained as described in the Privacy Policy.

4. Subscriptions and Billing

• Nourish+ is an auto-renewing subscription sold through Apple's in-app purchase system.
• The app shows the current localized price, billing period, renewal terms, and any trial for which Apple confirms you are eligible before you purchase.
• Payment is charged to your Apple ID. Unless cancelled, the subscription renews automatically under the terms shown by Apple.
• Manage or cancel through Apple's subscription settings. Deleting the app or your Nourish account does not cancel billing.
• Restore Purchases is available in the app. Refund requests and billing disputes are handled under Apple's policies.

5. Your Content

You keep ownership of photos, descriptions, logs, reactions, and other content you submit. You grant Nourish a limited, worldwide license to host, copy, process, transmit, and display that content only as needed to operate, secure, and support the service. Personal data is shared with AI providers only after the explicit permission described in our Privacy Policy, and optional analytics and diagnostics are controlled separately. You represent that you have the rights needed to submit your content.

6. Acceptable Use

You may not:

• Access another person's account or data without permission
• Upload unlawful content or content that violates another person's rights
• Interfere with, probe, overload, or bypass service security
• Reverse engineer the service except where law expressly permits it
• Use automated means to abuse the service or evade usage limits

7. Service Availability and Changes

We may update, add, remove, suspend, or discontinue features. Cloud, AI, authentication, and App Store services can be unavailable or delayed. We do not guarantee uninterrupted operation or that every feature will work on every device, operating system, or network.

8. Intellectual Property

Nourish and its software, design, branding, and service content are owned by Nourish or its licensors and are protected by applicable intellectual-property laws. These Terms give you a personal, limited, non-transferable right to use the service; they do not transfer ownership of Nourish intellectual property.

9. Disclaimer and Limitation of Liability

To the extent permitted by law, Nourish is provided "as is" and "as available" without warranties of any kind. To the extent permitted by law, Nourish is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded.

10. Suspension and Termination

We may restrict or end access if you materially violate these Terms, threaten the service or other users, or if required by law. You may stop using Nourish at any time and may delete your account in the app. Sections that by their nature should survive termination will remain in effect.

11. Changes to These Terms

We may update these Terms as the service or law changes. We will post updated Terms here, revise the date above, and provide additional notice when required. Continued use after updated Terms take effect means you accept them.
